Our Terms & Conditions

This Terms and Conditions Agreement sets forth the legally binding terms for your use of our Services. By using our Services, you agree to be bound by this Agreement, whether you are a visitor (which means that you simply browse the Website) or you are a member (which means that you have registered with Hanaz Writers and set up an Account). The term “user” refers to a visitor or a member.

By using our website and the services we offer, you are agreeing to follow and are bound by our term and conditions and Hanaz Writer’s privacy policy which are hereby incorporated by reference. If you do not wish to be bounded by these terms and conditions and the privacy policy, you may not access or use our website and the services offered by Hanaz Writers.
 

You represent and warrant that you are authorized to enter into this Agreement on behalf of yourself and/or the entity that you purport to represent. 

 

Terms 
This Agreement shall remain in full force and effect while you use the Services or are a Member. You may delete your Account and end your membership at any time, for any reason by contacting Hanaz Writers’ customer support team. Hanaz Writers may terminate your membership at any time and for any reason, effective upon sending notice to you at the then current email address in your account profile. Even after any termination, our terms and conditions will remain in effect. You understand that termination of this Agreement and your Account involves deletion of your Hanaz Writers profile information from our database, as well as any Content that you uploaded to the Hanaz Writers Website using such Account. Hanaz Writers will not have any liability whatsoever to you for any termination of your Account or related deletion of your information.

 

Amendments 
Hanaz Writers may modify this Agreement from time to time and such modification shall be effective immediately Hanaz Writers sends out an email containing a notification of such modifications and the continued use of the Services by the Member thereafter, shall constitute the Member’s acceptance of the amended Agreement. If you do not agree to the modification, you must cease your use of the Services.

 

Copyright 
You, the writer, inherently own the copyright of any creative works you create just by the process of creating it. You do not need to register your short story with the copyright office for your work to be copyrighted (although there are some added legal benefits if it ever comes to a lawsuit) nor do you need to declare it copyrighted somewhere in or on the text. 

Hanaz Writers have the right to share your book both electronically and in print, with the general public. The Hanaz Writers is not liable for any damages as a result of complaints made about the content by third-parties including defamation charges.

 

 

License Grant
By posting any User Content on the Service, you expressly grant to Hanaz Writers a nonexclusive, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Hanaz Writer for all claims resulting from content you supply.


Plagiarism
By submitting, the author warrants that their story is original, fictional, and entirely their own work. The author warrants that the story they have submitted does not infringe the copyright or any other rights of any third party and is not libellous, unlawful or defamatory of any living person or corporate body.

Eligibility
By using the Services, you represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are in the U.K. and eighteen (18) years of age or older, or in the EU and sixteen (16) years of age or older; and (d) your use of our Services does not violate any applicable law or regulation. Your Hanaz Writers Account may be deleted without warning if we believe that you are in the U.K. and younger than eighteen (18) or in the EU and younger than sixteen (16). 


Age Restrictions
Our website is not intended for use by individuals under the age of 18 for any products or services available on or via the websites.
We do not knowingly or intentionally process the personal information of any individual under the age of 18.
You must not use our website, purchase or attempt to purchase any of our products or services, or submit any personal information to us, if you are under the age of 18.


Payment and Invoicing
You acknowledge that Hanaz Writers reserves the right to charge for Services and to change its fees from time to time in its discretion, upon posting by Hanaz Writers on the Website. Upon using the Services, you will be responsible for the payment of any applicable fees, and shall pay such fees to Hanaz Writers as set forth on the Website. 

We will issue you a valid tax invoice in respect of each service. We will notify you as soon as the deliverable is ready for download. You will be required to pay all fees before publishing or other relevant services. Except as specified herein or in the Order Form (i) fees are based on the Services requested / purchased and not actual usage, (ii) payment obligations are non-cancellable and fees are non-refundable.

Payments shall be made: (a) in full without set-off, counterclaim or withholding of any kind (save where and to the extent that this cannot by law be excluded); and (b) in the currency mentioned in the order confirmation.

You are responsible for providing complete and accurate billing and contact information to us and notifying us of any changes to such information

We may re-issue any invoice if any error is later discovered. If you have overpaid as a result of a billing error, your account will be credited with the overpayment or, if you have stopped acquiring the Service from us, we will refund the overpayment promptly after your request and after deduction of any other amounts due by you to us.

Billing Dispute
You must notify us in writing within seven (7) days after receiving your credit card statement, if you dispute any of our charges on that statement, or such dispute will be deemed waived. Billing disputes should be notified to our Customer Service at the following address: 1a Dalling Road, King Street, Hammersmith, London [postcode] or via Hanaz Writers’ contact email [pls state email here], that can be found on the website. If Hanaz Writers does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by Hanaz Writers or its agents.

You may dispute an amount invoiced by us but only if you do so in accordance with this clause:

Except to the extent you raise a valid billing dispute in respect of our invoice, you agree that the invoice is valid and payable (and you must pay any undisputed amount included in the invoice in accordance with this clause 'Fees and Invoicing'

To raise a valid billing dispute, you must (i) make a good faith request to us to investigate the specific charges or invoice, providing at the same time specific evidence which demonstrates that a particular charge or invoice is incorrect; and (ii) make any such request to us within 1 month of the date of the relevant invoice.

On receiving good faith dispute request from you, we will conduct investigations which are reasonably necessary and appropriate in the circumstances of the dispute. At the end of these investigations, you will pay any outstanding amount within twenty (20) Business Days.


Regulatory Powers
You hereby acknowledge and agree that we reserve the right to: limit, deny, or restrict the use or access the Site in entirety or certain portions of the Site to specific users, including yourself, at its sole discretion;

Reject a user from registering on the Site without assigning any reason thereof;

Suspend/cancel/deactivate any user’s account/registration for any reason that we shall deem fit, or

Delete, edit, or move any Content Posted on the for any reason whatsoever.

Use your name, logo or any other trademark for marketing and promotional activities if you’ve availed any service(s) from our website. Such usage shall be in a manner that does not derogate your rights in your trademarks, names and logos by us.

Use your data to analyze, develop and build services, tools and systems for customer’s benefits.

Confidentiality
We shall maintain complete confidentiality of user data, including manuscript uploaded on this platform. All vendors are contractually obliged to maintain strict confidentiality of user data and have agreed not to disclose such confidential information to unauthorised. Access to the user data is limited to the person who is in charge or required to work on the document. We also assure compliance with applicable laws concerning the protection of personal information and promise to handle Customer's personal information with great care.

The information collected from the users by us shall be held and maintained in accordance with our 'Privacy Policy'.

 

Changes to the Site and These Terms
We may alter or modify the features of the Site with respect to different user(s), or change any of the features or introduce new features on the Site without prior notice to any user.

We reserve the right, at our sole discretion, to change, modify, add, or remove any portion of these terms and conditions, in whole or in part, at any time, temporarily or permanently, without notice and without liability, by posting revised terms on the Site. You hereby agree that it is your responsibility to check periodically for any changes made to these terms and conditions. Your continued use of the Site after any changes to these terms and conditions signifies your acceptance of the updated terms and conditions.

 

Breach Of Terms and Conditions
When a breach of these terms and conditions has occurred, we may take all or any of the following actions or any action that is deemed appropriate, including but not limited to the following:

Immediate, temporary, or permanent withdrawal of your right to use the Site;


Issuance of a warning to you;

Initiation of legal proceedings against you for reimbursement of all resulting costs and expenses suffered by us on an indemnity basis (including but not limited to reasonable administrative and legal costs); and

Disclosure of such information to law enforcement authorities as is reasonably necessary.

We hereby expressly disclaim all liability for any and all actions taken by us in response to a breach of the terms and conditions committed by you.
